Test results: If the test subject drowns, then it is possible he did it? If she survives, he's innocent?

I have experienced a toilet to become clogged at times on almost nothing and fill almost to spilling over and then in a minute or so the water would go down as it should have when flushed.and yes ,its happened when someone threw-up in it .Just enough matter gets caught and the toilet fills and after a minute or so the weight of the water in the bowl is just enough to push it through. a faulty vent system can also cause much the same problem.
This poor smuck could be telling the truth.and from what I understand this test won't even come close to what I have described and he could go to prision a innocent man.

Your provably right, they won't think of that. Provably isn't on the list of variables considered. From what I understood this test is suppose to prove or disprove 2 things. The first is could she have drown by herself. The 2nd has to do with some rings or bruises that were on her neck. Could they have gotten there without force is how I understood it.
